The China National Intellectual Property Administration has issued the Notice of Trademark Rejection for the application of the trademark "Huixiabao" to be used in goods such as "providing insurance information; insurance consulting; health insurance underwriting". The use of the logo in designated services is likely to cause the public to misunderstand the contents of services and other features, and it should not be used as a trademark.
The applicant believes that the application for the trademark "Huixiabao" is a term with a specific meaning. "Huixiabao" (a universal commercial supplementary medical insurance tailored by eight government departments for Xiamen medical insurance participants) is jointly promoted by eight departments including the Xiamen Supervision Bureau, the Xiamen Medical Insurance Bureau, the Xiamen Finance Bureau, the Xiamen Civil Affairs Bureau, the Xiamen Health Commission, the Xiamen Veterans Bureau, the Xiamen Finance Bureau, and the Xiamen Disabled Persons' Federation. "Huixiabao" aims to resolve the risk of major illnesses among the public, solve the problem of poverty caused by illness and returning to poverty due to illness, and further fill the gaps in protection outside the scope of medical insurance. It operates according to the principle of "government promotion, public welfare operation, commercial insurance undertaking, and self financing", and applies for the trademark "Huixiabao". It already represents the service characteristics of the project and applies for the trademark "Huixiabao" Its purpose is to benefit the people's livelihood in Xiamen.
In the Trademark Law, trademarks that are rejected due to the "absolute reasons" clause are often rejected by the Trademark Office because the trademark itself does not comply with the provisions of the Trademark Law, rather than conflicts with other existing trademarks (i.e. "relative reasons"). When a trademark is rejected due to absolute reasons, the probability of successful re examination is extremely low.
Finally, the trademark reexamination case of "Huixiabao" received the decision of the China National Intellectual Property Administration for preliminary examination in June 2024, and the reexamination was rejected successfully!
